Our Holiday Agreement.
1.Conditions of Hire
Our agreement with you binds you and all members of your party, including children. It is your responsibility to ensure that you and members of your party are aware of, and accepts the whole of this agreement and its obligations. It is effective from the date our agreement is formed and continues until the last member of your party has left.
We reserve the right to:
• Refuse to confirm any booking
• Obtain the name age and gender of each member of your party before confirming your booking.
• Refuse or cancel a booking if any member of your party has, or has just had infectious or contagious medical condition.
We have the right to cancel your booking, or to instruct you and your party to leave immediately, without compensation or refund should you not comply with any part of this agreement, especially the regulations relating to behaviour.
You may not advertise or resell your holiday without our express written permission.
You may not bring any firearm or air weapon, archery equipment or similar item under any circumstances.
The maximum number of occupants must not be exceeded in any accommodation. There may be exceptions with babies or young children.
Bookings for parties of all young persons or all male or female young people will not be accepted. Where such parties may be found in residence they will be required to vacate and shall not be entitled to any refund or any compensation.
Prices include VAT and are subject to change should the VAT rate alter.
We would like to remind you that Vauxhall Holiday Park is in no way responsible for the loss of, or damage to your property while you are on the park. We recommend that you insure your personal effects, clothing and cash in the normal way before coming on holiday.
Vauxhall Holiday Park will not be held responsible for any damage or inconvenience caused by acts of God including extreme weather conditions.
FORCE MAJEURE
We cannot accept responsibility or pay compensation for circumstances which amount to ‘force majeure’, which subsequently affect the provision of our service to you.
Completion and signature of the booking form signifies acceptance of conditions of hire shown on this page. This application is also an application for free membership to Vauxhall Holiday Park clubs during residence at the Holiday Park and Indoor pool complex during residence.
Accommodation
All holiday homes are available from approximately 4pm on the day of arrival and must be left in a clean and tidy condition not later than 10am on the day of departure. If on arrival you find any fittings, utensils, crockery or cutlery is broken, damaged or missing, please report it to reception. Please treat your accommodation with care and respect. You will be held responsible for any damage caused during your stay.
We reserve the right to charge you during or after your stay for any loss or damage to our property.
We reserve the right to enter your accommodation at any time for any reasonable purpose, for example, to make checks, or carry out essential inspection, maintenance work, housekeeping or repairs.
No tents to be used as additional accommodation for Holiday Home or Touring sites.
Please do not erect any linen line, as these can be dangerous.
Touring pitches are available from 11am on the day of arrival to 10am on day of departure.
In addition to your Touring Caravan and car parking space only one awning per touring pitch is permitted - please keep within the boundary of your pitch as outlined on the site map on your arrival. Please vacate by 10 am, late departures could incur extra charge.
Booking Offers
2009 School Holiday Prices held, relates to Holiday Homes only and is subject to movement of some dates such as Easter and Bank Holiday Periods. Offer can be used in conjunction with “Extra Week Saver” to gain maximum discount, no other offers can be applied. Full payment must be made at the time of booking.
ALL OFFERS CAN BE WITHDRAWN AT ANY TIME. ALL OFFERS ARE LIMITED AND SUBJECT TO AVAILABILITY AND MAY CLOSE BEFORE DATES DISPLAYED.
Booking Deposit
When you book, the deposit stated must be sent. For online bookings this is due immediately. This may also include your subscription to Vauxhall Holiday Park cancellation insurance.
Securing your Booking
You must make the payments by the appropriate time, or we will have the right to cancel your booking.
Please do not send cash in the post.
Final payments are due at least 40 days prior to the starting date of your holiday.
Please quote your booking number with any payments.
Booking cancellation.
If you are compelled to cancel your holiday you must notify us immediately by telephone. Then you must confirm it in writing using 1st Class mail, enclosing your Hire Invoice telling us whether your balance of hire money has been paid. Our acknowledgement in writing to you will be your confirmation that your booking has been cancelled. We will then endeavour to re-let for you. If we are successful in re- letting, you will only forfeit your booking deposit. If we cannot re-let, then you will be held responsible for a prompt payment of the full balance of hire due on the Holiday Home or Touring Site booking. Should you have to cancel within 45 days of your holiday, you must telephone us first, and follow this with a written confirmation by 1st Class mail. In the case of Holiday Homes, your subscription to Vauxhall’s Cancellation Insurance covers you for all or part of these liabilities if you cancel for one of the qualifying reasons.
The Holiday Home Number, or Pitch Number notified to you on confirmation of your booking is provisional and we reserve the right to alter this number, but this will occur only in exceptional circumstances.
In the event of non-arrival we reserve the right to re-let the holiday after 12 noon on the following day.
2 Safety
You must obey the speed limit on the Park
Cyclists must give way to pedestrians.
It is recommended that appropriate safety helmets be worn when cycling. Do not use a scooter, cycle, skateboard or roller blades in any buildings.
Diving is not permitted in the swimming pools.
Do not enter or attempt to use any facility that is closed.
You are required to follow any additional safety advice given by our staff.
3 Dogs & Pets
No pets (Only Guide Dogs) are allowed on the park
4 Behaviour
Your behaviour should not be excessive, noisy or disruptive, especially at night. You must show consideration to other guests and staff. Offensive or illegal behaviour will not be tolerated.
5 Children’s supervision and Parental responsibility.
You are responsible for the supervision of all members of your party under the age of 18. You must supervise your children at all times, this is particularly important in the Play Areas, The Swimming Pools and the Licensed Bars.
You must collect your child(ren) from supervised activities at the appointed times.
6 Access and Vehicles
Sorry we do not accept transit vans or equivalent commercial vehicles on the park.
Please at all times,
• Observe the 5mph speed limit
• Give way to pedestrians
• Keep to the left
• Drive, manoeuvre and park carefully
• Do not park on double yellow lines
Sleepers – No liability is accepted for any damage caused by these.
7 Licensed premises.
We may not serve or sell alcohol to anyone under the age of 18. Please do not allow any of your party who is;
M Under 18 to attempt to buy alcohol at any of our outlets, or use any gaming machine with a jackpot of £25 or more, or attempt to buy solvent based products.
• Under 18 to attempt to buy cigarettes.
We reserve the right to refuse to serve alcohol to anyone;
- should they not prove their age to our satisfaction, or
- to someone we consider has been drinking excessively.
We will accept police approved identity card schemes such as “Prove it” or a passport or new-style driving licence as proof of age.
8 Security of your property.
Your personal belongings are your own responsibility during your stay on the park.
Any vehicle parked on our property is subject to very limited security cover. You must lock your vehicle and remove any valuables.
We accept no liability whatsoever for any accident, loss or damage to your property unless such loss, damage or accident is demonstrably due to our negligence or that for whom we are legally responsible.
9 Smoking
Smoking is not permitted in some accommodation and indoor areas including the Swimming Pool, parts of the Regency Room, Louie’s Den and the Restaurant.
10 Activities
All activities and facilities are subject to availability and no compensation will be payable where activities or facilities are unavailable.
“Peak Weeks only” means - Easter, weeks 4, 12,13,14,15,16,17 and October Half Term
As we continue to improve accommodation and facilities and comply with Health & Safety legislation or other legal requirements you may find that:
• Some facilities have been altered
• Listed facilities are temporarily closed for maintenance
• There is development or refurbishment work in certain areas although in such circumstances we try to minimise any inconvenience.
11 Data Protection
All the information contained in our bookings is held on our computer system for which we are registered and comply with the regulations of the Data Protection Act.
We will not sell this information, and only use it for marketing and information purposes relating to Vauxhall Holiday Park Ltd.
12 Phone Calls
To ensure standards are maintained we may record or monitor phone calls
13 Brochure Content
The information supplied is correct at the time of going to press. Facilities and Entertainment may vary from that published. Vauxhall Holiday Park will endeavour to notify all customers of any significant changes. All rights are reserved to Vauxhall Holiday Park and the designers Lindon Parriss Ltd
We regularly take photographs and videos for promotional and training purposes. Every effort is made to ensure this does not affect your holiday. Please ensure that you and your family are aware of the positioning of the cameras at all times. We will not accept responsibility if, contrary to your wishes, you appear on film or in photographs and we do not make any financial award or payment of any kind.
14 Reporting procedure.
In order for us to rectify any of your concerns, please advise us of any problems or concerns immediately. We will endeavour to respond to these promptly in order for you to continue to enjoy your holiday. Any reported matter, which has not been resolved during your stay, should be advised in writing to the General Manager within 28 days of the end of your stay.
Please note we are not responsible for any matter of which you were aware and which you did not bring to our attention during your stay.
Holiday Home Cancellation Insurance
Protecting your Vauxhall Holiday - When you book your Holiday Home you become responsible for its full hire-terms even if you are unable to take your holiday as planned. This is only a fair and reasonable safeguard for Vauxhall who on your instruction have reserved exclusively that accommodation for you. In fact, unforeseen circumstances inevitably result in some holiday cancellations, or some problem will arise while you are actually on holiday. To protect you against these responsibilities you can choose to be included in our Cancellation Insurance Scheme when you book. Your deposit will include a subscription per week to cover your Holiday Protection Insurance. This applies only to Holiday Homes (Caravans or Chalets).
Cancellation Insurance - Under the terms of our Cancellation Insurance you are relieved of the responsibility for payment of the balance-of-hire (and most often you can get your booking deposit back) if:
1 You are forced to cancel prior to your holiday because of illness, death, injury, maternity, or illness of any member of your party. Or because of Witness or Jury service by you or your wife. Or because of your own redundancy. (Qualifying for payment under the Redundancy Payments Act 1965) Or because of your own unforeseen occupational posting. Or because of fire, storm, flood subsidence or malicious damage rendering your home uninhabitable. Or because of the police requiring your presence following a burglary at your home or place of business. Or because of death or serious injury or illness of a close relative* or death of a business associate, partner or co-director. And you can provide supporting documentary evidence, that has arisen since you made the booking, then you will no longer be liable for the balance of hire monies due on your booking. To qualify you must notify us in writing immediately the circumstances arise. Our acknowledgement in writing to you will be evidence of our having received your notification. In the case of multiple or party bookings, (i.e. - where more than one Holiday Home is booked at the same time), cover is assessed on each Holiday Home individually. This cover also provides you with a refund of your balance-of-hire if such qualifying circumstances arise before you leave home for your holiday and even where you have already paid your balance-of-hire in advance.
2 From the date of the start of your holiday, if any of the circumstances listed in Clause 1 force you to curtail your holiday and return home, then cover extends to give you a proportionate refund of the balance-of-hire you paid for your Holiday Home. If serious illness or accident is the reason then you’ll need documentary evidence from a doctor in the holiday area.
3 And also, provided we receive written notice from you more than 45 days before your holiday is due to start, and you are cancelling for one the reasons given in Clause 1 your booking deposit will be returned to you in full.
4 If we receive written notice from you 45 days or less before the start of your holiday, and provided you are cancelling for one of the qualifying reasons then one half of the deposit you have paid for each week cancelled will be refunded if we re-let for the full period of your holiday for the full hire charge.
5 If you cancel for circumstances not covered in this scheme and we receive notice from you in writing more than 45 days before you’re due to start your holiday then you only forfeit your booking deposit for each week cancelled. But if we receive notice to cancel from you 45 days or less before you’re due to start your holiday and your reason for cancelling isn’t one of the qualifying ones you forfeit your booking deposit and you’ll be responsible for the payment of the balance-of-hire if we don’t re-let for each week cancelled.
The decision of Vauxhall Holiday Park Limited on all claims will be final.
*Close relatives means the husband, wife, father, mother, father-in-law, mother-in-law, brother, sister, child or dependent of person in whose name the booking is made. Exclusion any consequences of war and radioactive contamination and similar risks.
Please note as per the terms and conditions of hire, you will not be allowed to erect and use the following on your pitch, Pup tents, Gazebos and Windbreaks. The pitch you are hiring is for either a touring caravan with or without an awning or tent. The pitch includes room for the parking of one car, extra cars will need to be parked in a car parking bay elsewhere on site.
